A father who beat his daughter’s alleged rapist to death near the rural town of Shriner, Texas, avoided charges for the incident.

A grand jury in Lavaca County opted not to press charges against the father, who killed 47-year-old Jesus Mora Flores when he allegedly caught him molesting the 5-year-old in a secluded shack on the family farm.

“Under the law in the state of Texas, deadly force is authorized and justified in order to stop an aggravated sexual assault or sexual assault,” District Attorney Heather McMinn said.

Before the incident, the girl and her brother went out to the feed the chickens. When Flores, a farmhand, picked up the girl and carried her to an out-of-the-way area, her brother ran back to tell his father, court records show. When the father learned of what had happened, he reportedly ran towards the shack, guided by his daughter’s screams.

When he arrived on the scene, the father says he found the child with Flores. Both reportedly had their underwear removed. The father began beating Flores out of rage, until the farmhand lost consciousness. The father then called 911.

Despite his anger, the father was concerned Flores might not survive the beating.

“Come on! This guy is going to die on me! I don’t know what to do,” he told a 911 dispatcher. At one point, he offered to drive Flores to the hospital in his own truck to help save his life.

The father’s name was not released, so as to protect his daughter’s identity. Immediately following the incident, Sheriff Micah Harmon stated he would not press charges and deferred the decision to a grand jury.

Harmon described the father as “very remorseful.”

“You have a right to defend your daughter … the girl’s father acted in defense of his third person,” he told CNN.
